Terms and Conditions

HOMEFRONT AUCTIONS - TERMS OF SALE

Version 2.0.1, in force from 15 September 2026.

These terms apply to every sale run by Homefront Auctions, on whichever platform you are bidding. Placing a bid means you accept them. Please read clause 16 in particular - it sets the two deadlines that cost buyers money more often than anything else here.

THESE TERMS ARE THE CONTRACT BETWEEN HOMEFRONT AND BUYERS. If you are consigning goods to us to sell, your contract with us is the Vendor Consignment Agreement, which we will send you to read before you commit to anything. It is not this document. See clause 21.

Homefront Auctions is a trading name of Homefront Auctions Limited, company number 15101977, VAT number GB461246309, EORI number GB096833076000. Registered office: 49 Tirmynydd Road, Three Crosses, Swansea SA4 3PB.

Saleroom, viewing and collection address - this is where the goods are, and it is not the registered office: Ashford House, Abergelly Road, Fforestfach, Swansea SA5 4DY. Telephone 01792 978155. Email info@homefrontauctions.co.uk.

PART ONE - GENERAL

1. Who we are and how our sales run

Homefront Auctions ("HFA") acts solely as agent and auctioneer for the seller. The contract of sale is between the buyer and the seller. HFA is not the seller of the goods except where a lot is expressly described as HFA's own property. HFA runs timed online sales. Bidding opens on a published date and each lot has a published closing time. Lots close one after another, in lot-number order. There is no saleroom bidding, no auctioneer calling lots and no attendance in person. Where a bid is placed in the last moments before a lot closes, the platform extends that lot's closing time automatically, so a late bid cannot win by timing alone. Where HFA runs a live sale it will say so on the catalogue. In a live sale lots are offered in order by an auctioneer and sold on the fall of the hammer. These terms apply to both formats. Where a term works differently in a live sale, the clause says so.

2. Definitions

Buyer - the person or business whose bid is the highest accepted bid for a lot when that lot closes. Lot - an item, or a group of items, consigned to HFA and offered for sale under a single lot number. Seller (or Vendor) - the person or business legally entitled to consign a lot for sale. Hammer price - the winning bid for a lot, before the buyer's premium and before VAT. In a timed online sale it is the highest accepted bid at the moment the lot closes. In a live sale it is the bid at which the hammer falls. Reserve - the minimum price agreed with the seller below which a lot will not be sold. Sale close - the time at which the LAST lot in a sale closes. Every deadline in these terms runs from sale close, not from the closing time of your individual lot. If you win lot 3 of a 600-lot sale, your clock starts when lot 600 closes, along with everybody else's. Maximum bid (also called a proxy or autobid) - the highest amount you are willing to pay for a lot, entered in advance. The platform bids on your behalf, one increment at a time, up to that amount, and no further. Written bid (also called a commission or absentee bid) - a bid you send us by email or give us by telephone, which we enter on the platform on your behalf.

3. Catalogue descriptions

Descriptions, measurements, dates, attributions and opinions in our catalogues, on lot pages and given to you by us in person are honest statements of opinion given in good faith. They are not guarantees. Photographs are part of the description. It is your responsibility to satisfy yourself about the condition and authenticity of a lot before you bid. Clause 3a tells you how to do that.

3a. Condition reports and viewing - how to check a lot before you bid

Clause 3 puts the job of checking a lot on you, so here is how to do it. Ask us. Email info@homefrontauctions.co.uk with the lot number and tell us what you want to know - more photographs, a measurement, a closer look at a chip, a hallmark, a signature, a maker's mark, whether something is complete. We would far rather answer before you bid than afterwards. How quickly we answer: within 24 hours. On the day of a sale we monitor condition report requests from 9am until the sale starts, so if you are still deciding on the morning, ask. A condition report is still an opinion, given in good faith by people who are not specialist restorers or authenticators. It does not extend clause 3 into a guarantee. Viewing in person is by appointment only. We do not hold open viewing days. If you want to see a lot before you bid, email info@homefrontauctions.co.uk with the lot numbers and we will arrange a time with you. Appointments must be made in advance - please do not travel to the saleroom expecting to view without one. We would rather you asked. If a lot matters enough to travel for, it matters enough for us to open the door for you.

4. Electrical and mechanical items

We do not test electrical items and we do not PAT-test them unless a lot description says otherwise. They are sold as untested and as seen. Do not plug in anything you buy from us until a qualified electrician has checked it. The same applies to gas appliances, tools and anything mechanical. This clause describes what we have and have not done. It does not affect your statutory rights - see clause 11.

5. Bidding, increments and reserves

The highest accepted bid when a lot closes wins that lot. Bidding increments are set by the platform you are bidding on, not by us, and the platform shows you the next valid bid. Reserves, and bidding on the seller's behalf. Some lots carry a reserve - a minimum price agreed with the seller, below which the lot will not be sold. WHERE A LOT HAS A RESERVE, WE MAY BID ON THE SELLER'S BEHALF, UP TO BUT NEVER AT OR ABOVE THAT RESERVE. That is how a reserve is enforced: it stops a lot selling for less than the seller agreed to accept. We are telling you this plainly because you are entitled to know it before you bid, and because we would rather you heard it from us than worked it out. We do not bid on our own behalf. We do not bid on lots that carry no reserve. We never bid at or above the reserve. Once bidding has passed the reserve, every further bid is a real bid from another bidder. A lot that does not reach its reserve is unsold. We may refuse a bid, refuse a registration, divide or combine lots, correct a lot, or withdraw a lot from sale at any time before it closes. If two bids are accepted at the same amount because of a platform fault or a disputed entry, we may re-open the lot or cancel and re-offer it. We will tell everyone who bid on it.

6. Corrections and notices

There are no spoken announcements in a timed online sale, so corrections are published in writing, on the lot page. A correction published on a lot page overrides the catalogue and every earlier description of that lot. We may correct a lot at any time up to the moment it closes. So check the lot page before you bid, and check it again if you are bidding close to the end. The lot page is the description you are bidding on.

7. Deliberate forgeries

If you believe a lot is a deliberate forgery, tell us in writing within 7 calendar days of receiving it and return it to us within 14 calendar days of receiving it, in the condition it was in when it left us, with your evidence. If we are satisfied by the evidence we will refund the full amount you paid for that lot - the hammer price, the buyer's premium and any internet surcharge.

8. If a buyer or a seller defaults

HFA is not responsible for a default by a buyer or by a seller. A seller is paid only after the buyer has paid us in full. If a buyer does not pay, the lot is not sold and the seller is not owed the proceeds of it. When a seller is paid is set out in the Vendor Consignment Agreement, not in these terms.

9. Visiting the saleroom

Our saleroom at Ashford House is a working warehouse and store. If you are collecting lots, delivering goods to us or visiting for any other reason:

- Follow any instruction given by our staff.

- Children must stay with the adult who brought them.

- Do not lift, move or handle stock yourself unless we ask you to.

- Vehicles, and anything you leave in them, are your own responsibility.

- Tell us before you arrive if you will need help loading, and we will make sure someone is free.

10. Instructions given by telephone or email

We will act on telephone and email instructions in good faith, at your risk, unless we have confirmed them back to you in writing. If an instruction matters - a written bid, a change of delivery address, an authority for somebody else to collect your lots - send it by email to info@homefrontauctions.co.uk and wait for our reply before you rely on it.

PART TWO - BUYING AT AUCTION

11. Bidding means you accept these terms

Registering to bid and placing a bid means you accept these terms of sale. Bids are final and binding. You cannot retract a bid once a lot has closed. However, this does not affect the statutory rights of consumers under the Consumer Rights Act 2015 where applicable.

12. Identification

We may ask you for photo identification and proof of address before we release lots to you, and we will normally do so for jewellery, gold, silver and higher-value lots. We may also ask before we accept your registration. You pay for your lots under clause 16. There is no earlier deadline than that one anywhere in these terms.

13. When a lot becomes yours

A lot becomes your responsibility when it closes and you are the successful bidder, not when you pay for it and not when you collect it. Insure accordingly if that matters to you. You must pay for a lot in full before you remove it or before we post it. For lots we post to you, the transit sections of our Shipping, Collection and Storage policy apply from the moment we hand the parcel to the courier - what the parcel is covered for, and what to do if it arrives damaged. See clause 20.

14. What you pay

You pay three things, and your invoice shows all three as separate lines:

1. The hammer price - your winning bid.

2. The buyer's premium - our charge.

3. The internet surcharge - Easy Live Auction's charge. See clause 14a.

Buyer's premium: 30% OF THE HAMMER PRICE, ALL IN. That is 25% of the hammer price, plus VAT on the premium at 20%. On a £100 hammer price the premium is £25 plus £5 VAT, £30 in total, so hammer and premium together come to £130.

Easy Live Auction's internet surcharge is then added on top of that, at the rate they show you when you register for the sale. It is calculated on the hammer price, not on the premium.

Your invoice lists every lot with its hammer price and its premium shown separately.

Lots marked with a VAT symbol. If a lot is sold on behalf of a VAT-registered business rather than by a private seller, the lot page says so and VAT is charged on the hammer price as well.

14a. Internet surcharge - Easy Live Auction only

Easy Live Auction charges an internet surcharge on lots bought through their platform. It is their charge, not ours. They set the rate and they may change it without reference to us, which is why we do not state it here.

The current rate - and, on live sales, the alternative of a single flat fee for the whole sale however many lots you win - is shown to you when you register for the sale, and you accept it there, before you can bid. See clause 19. Whichever applies, it appears as a separate line on your invoice, and we collect it on Easy Live Auction's behalf.

Easy Live Auction describes their surcharge as being over and above the auctioneer's buyer's premium. That means in addition to our premium, not on top of it: their percentage is applied to the hammer price alone. Where a lot page shows one combined percentage, that is our premium and their surcharge added together.

There is no internet surcharge on lots bought through Bidspirit.

15. Maximum bids and written bids

Maximum bids. Enter the most you are prepared to pay and the platform bids for you, one increment at a time, up to that figure. It stops there. Setting a maximum does not commit you to paying it - you pay one increment above the next highest bid, up to your maximum. There is no charge for this and it is the normal way to bid in a timed sale. Written bids, for people who would rather not bid online. Email your lot numbers and your maximum for each to info@homefrontauctions.co.uk, or ring 01792 978155 and we will take them down. We enter them on the platform for you and we do not charge for it. Send them in good time - the day before the sale if you can. If you need to send one on the morning of the sale, ring 01792 978155 as well, so that we know to look for it. We take reasonable care with written bids, but we cannot accept responsibility for a bid that is missed, mis-entered or affected by a platform or network fault. If a written bid matters to you, bid online as well or ring to confirm we have it.

16. Payment and collection - the two deadlines

There are two deadlines and they are both 7 calendar days from sale close. A sale that ends on a Friday must be paid for by the following Friday and collected by the following Friday. If a deadline falls on a day we are closed - a Sunday, or a bank holiday - it moves to the next day we are open, and both deadlines move together. They are separate deadlines and missing them costs you different things:

- Miss the payment deadline and you can lose the lot. If a lot is unpaid at 7 days and we have heard nothing from you, it is cancelled and goes back into a future sale, and you may be blocked from bidding with us again. We contact you before that happens, and if it is resolved within 48 hours of us contacting you, neither applies.

- Miss the collection deadline and storage charges start. Storage is £5 per lot, per day from the day after the deadline until your lots are collected.

You can only collect lots you have paid for. None of this is aimed at anyone who talks to us. If either deadline is going to be a problem, ring 01792 978155 before it passes and we will almost always sort something out. We do not mind holding your lots for longer. What we cannot do is hold lots for someone we cannot reach. If we hear nothing at all: on day 7 we write to you - your lots are ready, storage starts tomorrow, and here is the date they would go back into a sale. On day 8 storage starts. On day 14, if we have still heard nothing, lots may be sold, at auction or privately; where lots you have already paid for are sold this way, we deduct the storage and the cost of selling them and send you the balance. Until a lot is collected, it remains at your risk and you are responsible for insuring it. Full detail of postage, collection hours, storage and uncollected lots is in our Shipping, Collection and Storage policy - clause 20.

17. How to pay

We accept bank transfer, and cash in person at the saleroom. We do not accept card payments and we do not accept PayPal. Our account is held with PayrNet Limited, and the payee name is Homefront Auctions Limited. PayrNet is the institution that holds the account; the money comes to us. Please quote the payment reference printed on your invoice - it tells us which sale and which bidder the money is for. Jewellery, gold and silver lots must be paid for in person. We do not take payment for those over the telephone. We do not take card details or payment instructions by email. If anyone emails you asking you to send money to different bank details, it is not us - ring 01792 978155 and check. If the payee name your bank shows you is anything other than Homefront Auctions Limited, stop and ring us before you send anything.

18. Governing law

All transactions are governed by English law.

19. Bidding through an online platform

Homefront sales on this platform are hosted by Easy Live Auction. When you bid here you are bound by these terms and also by Easy Live Auction's own terms and conditions, site usage terms and privacy policy, which are published at easyliveAuction.com/legal. Easy Live Auction is a separate company. We are responsible for the sale of the goods; they are responsible for the platform and your account with them. The internet surcharge in clause 14a is Easy Live Auction's charge, not ours. You agree to it with them when you register for the sale - it is the surcharge you tick to accept before you can bid. We collect it from you on their behalf, together with everything else on your invoice, and pass it on to them. That is why a charge of theirs appears as a line on an invoice from us.

20. Postage, collection and storage

Our Shipping, Collection and Storage policy forms part of these terms and is published in the Shipping section of this page. It covers postage prices and the extra handling charge, what a parcel is covered for, furniture and large lots, collection at the saleroom and its opening hours, the two deadlines in clause 16, storage, uncollected lots, and what to do if something is lost or arrives damaged. Deliveries require a signature. Report transit damage to us within 7 calendar days of delivery, with photographs of the packaging - photograph it before you open it. We are not liable for loss or damage in transit once a parcel has been dispatched; tell us and we will make the claim against the courier for you.

PART THREE - HOW WE SELL, AND FOR WHOM

21. We sell as agent for the seller, under a separate agreement

Everything Homefront sells is consigned by somebody else. We act as agent for that seller and the contract of sale is between the seller and the buyer. Consignors contract with us separately, under a Vendor Consignment Agreement. That agreement sets out the goods, the commission, the reserves, when the vendor is paid, what happens to anything that does not sell, and how the goods are insured while they are with us. IT IS THE CONSIGNOR'S CONTRACT IN FULL - these published terms do not add to it, vary it or sit behind it. If you are thinking of consigning, ask us for the Agreement before you commit to anything. Email info@homefrontauctions.co.uk or ring 01792 978155 and we will send it to you to read in your own time. Nobody should sign a consignment contract in a hurry, and nobody should sign one they have only skim-read at their own kitchen table.

22. Title, and what a seller has told us

A seller warrants to us that they own the goods they consign, or are authorised to sell them, and that the goods are free of any charge or third-party claim. Title stays with the seller until the buyer has paid in full. It then passes directly to the seller's buyer.

23. Lotting and reserves

We decide how goods are lotted. We may divide a lot, combine lots, re-photograph, re-describe, move a lot to a later sale, or withdraw a lot before it closes. Some lots carry a reserve agreed with the seller. How a reserve works, and what we do when a lot has one, is set out in clause 5.

24. Insurance of goods in our care

Goods consigned to us are insured under Homefront Auctions' business policy against loss or damage while they are in our care, custody and control. The basis of cover is set out in the Vendor Consignment Agreement.

PART FOUR - ADMINISTRATION

25. Complaints

If something has gone wrong, tell us. We would far rather hear it than not. Email info@homefrontauctions.co.uk with COMPLAINT in the subject line, or ring 01792 978155 and ask for the partner responsible for complaints. Please put it in writing if you can, and tell us the sale date, the lot number, what happened and what you would like us to do about it. What we commit to:

- We acknowledge every complaint within 1 working day, so you know it has reached a person.

- We give you a full answer within 10 working days.

- If it is going to take longer than that - a courier claim, or a lot that has to come back to us before we can look at it - we will tell you so inside the 10 days, explain why, and give you a date.

- If you are not satisfied with our answer, say so and the other partner will review it. That review is the final stage of our internal complaints procedure.

Complaints about the bidding platform go to the platform, not to us - your account, registration, or a bidding fault. See clause 19. Anything about the goods, the description, the invoice, payment, postage or collection is ours, and we will not pass you between the two.

26. Your information

We use the information you give us to register you, to run the sale, to take payment, and to deliver or release your lots. We keep what we have to keep for tax and accounting purposes. The platform you bid through holds your registration and bidding information separately, under its own privacy policy - see clause 19. If you want to know what we hold about you, email info@homefrontauctions.co.uk.

27. These terms

Version 2.0.1, in force from 15 September 2026. These terms replace all earlier versions.

The version number and date above appear on every surface where these terms are published. If you are comparing two copies and the version lines do not match, the copies are not the same and we want to know - email info@homefrontauctions.co.uk. We publish these terms on Easy Live Auction and on Bidspirit. The version in force for your purchase is the one published at the time you bid.

END OF TERMS

Protecting Auctioneers

To ensure the protection of all parties we work with from any form of illegal, unfair, or inappropriate behaviour, we take practical measures. This involves keeping track of account activities, including user contact information, device usage, website activity, bidding history, purchase records, and payment history. This information is shared with other relevant partners, such as auctioneers, to assist parties in managing their commercial risks in the context of our joint services.

In the event that behaviour is deemed inappropriate or presents a threat, we reserve the right to temporarily halt automatic approvals. In such cases, you will need to directly communicate with the auctioneer in order to participate in their auction.

White Label Platforms

When we offer technological services to an auctioneer, you become a direct customer of the auctioneer and they assume the role of data controller. The auctioneer is accountable for the handling of your data. Any enquiries or concerns regarding your data should be directed to the auctioneer.
